The man accused of killing 22 people at a busy Walmart in the Texas border city of El Paso last month has been indicted by a grand jury and could face the death penalty.
Patrick Crusius, 21, of Allen, Texas, was indicted on a federal capital murder charge for the shooting on Aug. 3 that also wounded 26 people.
"Capital Murder is the highest charge in the State of Texas and is punishable by death or life imprisonment without parole if found guilty," the district attorney's office said in a news release.
Crusius allegedly told police he was targeting "Mexicans" in the shooting.
Shortly before the attack, authorities believe Crusius posted a manifesto online, expressing anger about a "Hispanic invasion" of the United States.
Authorities said Crusius drove more than 10 hours from his hometown near Dallas, Texas, to the predominantly Hispanic border city of El Paso to carry out the shootings. Eight of the dead were Mexican nationals.
The El Paso attack came hours before another mass shooting in Dayton, Ohio, that left nine people dead.
It was followed weeks later by another shooting in Odessa, Texas, that killed seven and wounded 22 others.
The shootings have led gun control activists to renew their calls for Congress to take up action to reduce gun violence.
